The Ukrainian Ministry of Development of Communities and Territories has announced a concession tender for Terminal No. 1 and the Container Terminal (the Universal and Grain terminals) at the Chornomorsk seaport, according to reports by the CFTS portal.

The objects of the concession are:

- the existing assets (including immovable and movable property) on the state-owned Chornomorsk Commercial Seaport’s balance sheet within the port’s Universal and Grain terminals;

- the existing property (including immovable and movable property, as well as berths Nos. 1–6) on the port’s balance sheet within the port’s Universal and Grain terminals;

- property created and/or constructed by the concessionaire in the process of implementing the concession agreement (including newly constructed immovable property by the concessionaire and movable property acquired by the concessionaire under the terms of the concession agreement).

The Ukrainian Ministry of Development of Communities and Territories is the grantor of the concession.

The concession term will be 40 years.

The deadline for submitting applications to participate in the preliminary selection phase is 75 days from publication of the announcement.

"Legal entities interested in participating in the concession tender may, if necessary, submit requests to the tender commission for additional information or clarifications regarding participation in the preliminary selection of bidders, in accordance with the procedure and requirements set out in the Instructions for Bidders," the ministry said.

Pursuant to Paragraph 8-8 of the Final and Transitional Provisions of the Law of Ukraine "On Concessions," the concessionaire will be selected in accordance with the procedure for conducting a concession tenders (competitive dialogue) established by the Law of Ukraine "On Concession" in the version before the amendments introduced by the Law of Ukraine No. 4510-IX "On Public-Private Partnership" dated 19 June 2025.

The grounds for denying participation in tenders or restricting participation in competitive bidding processes that are stipulated in Part 2 of Article 17 of the Law of Ukraine "On Concession," as amended by the Law of Ukraine No. 4510-IX "On Public-Private Partnership" dated 19 June 2025, will apply to applicants.

The concessionaire will be selected during the competitive dialogue stages stipulated in the Law of Ukraine "On Concessions" (in the version before the amendments introduced by the Law of Ukraine No. 4510-IX "On Public-Private Partnerships" dated 19 June 2025).

In addition, in accordance with the provisions of Part 3 of Article 18 of the Law of Ukraine "On Concessions" (in the version before the amendments introduced by the Law of Ukraine No. 4510-IX "On Public-Private Partnership" dated 19 June 2025), after completing negotiations on the concession project with the participants, the tender commission will prepare the terms of the concession tender, instructions for participants, a draft concession agreement, as well as other documents necessary for conducting a competitive bidding process and submit them to the grantor of the concession for approval.
