Roman Marchenko, a senior lawyer with the Ilyashev & Partners law firm, which represents the interests of the Antonov state enterprise, has said that the Ministry of Industrial Policy lost its authority and control over industrial enterprises on 24 April.
"According to a resolution of the Cabinet of Ministers, ministries should arrange transfer of all materials and cases from one ministry to other (from the Ministry of Industrial Policy to the Ministry of Economic Development and Trade) within one month. This means that the Ministry of Industrial Policy completely lost all its rights regarding all state enterprises on 24 April 2014. Essentially, the Ministry of Industrial Policy is ignoring the government's decision by not completing the transfer of all cases to the Ministry of Economic Development and Trade and continuing to stamp out unlawful orders,” Marchenko said at a press conference on Friday, the CFTS reports.
In addition, according to him, these orders themselves contain numerous violations of the current legislation. In particular, according to him, the head of Antonov is working under an employment contract that will expire in February 2015, and its early termination requires a very good reason, which does not exist in the current situation. In addition, he said that dismissal or appointment of the head of this strategic enterprise must be agreed with the Kyiv city administration and that the city authorities rejected the relevant initiative of the Ministry of Industrial Policy in a letter dated 6 May.
As reported, the Cabinet of Ministers issued the directive No. 408-r on abolition of the Ministry of Industrial Policy and transfer of the state enterprises under its control to the Ministry of Economic Development and Trade on 23 March this year. However, Deputy Minister of Industrial Policy Oleksandr Kalenkov has said that the Ministry of Industrial Policy continues to operate normally and retains all the powers necessary to make personnel appointments because the process of abolition of the ministry and transfer of enterprises has not yet been completed.
Earlier, the press service of the Ministry of Industrial Policy announced that Serhii Merenkov had been appointed as the acting President/General Designer of the Antonov state enterprise from August 1, 2014. However, employees of the state enterprise prevented a takeover of the state enterprise’s seal. "Alerted by security, the enterprise’s self-defense units and employees encircled the ‘raiders’ and expelled them from the territory of the enterprise," the press service of Antonov said.
